This document provides critical scientific, medical and legal considerations by which States can end or mitigate the overly broad criminalisation of HIV non-disclosure, exposure and transmission. The aim of providing these
considerations to law and policy-makers, judges, prosecutors and advocates is to help to ensure that any application of criminal law in the context of HIV
achieves justice in truly blameworthy cases, while still safeguarding public health goals and human rights.
